It’s easy to assume that your HOA knows what it’s doing. Until it doesn’t.
Boards are bound by their own documents—and by state law. But too often, they skip steps: voting in secret, denying due process, spending outside the budget.
Examples include:
Not sending proper notice of meetings
Fining without a hearing
Approving contracts without bids
Holding elections improperly
If your board isn’t following its own rules, you have the right to:
Request records
Demand procedural compliance
File a complaint
Call for a recall or vote of no confidence
They’re not the government. They don’t get to operate above the law.
