When Rules Cross the Line

Not all HOA rules are enforceable — and not all boards follow proper procedures when changing them. Cases of retroactive rental bans, sudden pet restrictions, or limits on guest stays often catch residents by surprise.
Most states require proper notice, a clear amendment process, and sometimes a community vote to make significant rule changes. Boards that skip steps — or enforce unwritten “policies” — can be challenged.
Selective enforcement is another gray area. Some residents find themselves fined for minor infractions while others get a pass. Courts often side with homeowners when rules are applied inconsistently.

Request records: meeting minutes, official amendments, or rule change notices.
Understand how new rules must be adopted under your governing documents.
When in doubt, gather neighbors with the same concerns — there’s strength in numbers.
